Victory for Payne & Fears LLP Client in Hostile Work Environment Suit
Payne & Fears LLP represented an employer headquartered in Seattle in an action pending in the United States District Court, Northern District of California, San Jose Division. The plaintiff, a male, alleged that he was constructively discharged and sexually harassed by a female who was the head of Human Resources. Payne & Fears LLP prepared a motion for summary judgment which showed a substantial amount of evidence regarding plaintiff’s poor work performance to establish a lack of pretext for terminating plaintiff.
