Cliff White has over 25 years of business litigation experience representing clients in a variety of matters.

Cliff has extensive experience litigating several types of business disputes including trademark and copyright infringement claims, insurance coverage, corporate disputes, commercial contracts, employment claims, real estate, and construction in both federal and state courts. Cliff especially enjoys helping clients obtain the insurance coverage they deserve from reluctant insurance companies. 

Cliff has won several cases on summary judgment motions and has successfully mediated and negotiated numerous settlements.

Background

Prior to joining Payne & Fears, Cliff was the head of litigation at his firm, where he focused on intellectual property and business litigation.

While an undergraduate, Cliff was a member of the UC Berkeley Ski Team.

Representative Matters

  • Prevailed on Summary Judgment Motion concerning insurer’s breach of its duty to defend arising from refusal to pay for insured’s affirmative claims conducted against liability for covered claims alleged in a cross-complaint resulting in settlement with insurer for unpaid defense costs.
  • Forced insurer to accept defense duty under professional liability policy for claims that employees stole trade secrets and confidential information from their former employer and later negotiated settlement of breach of duty to indemnify claims after insurer refused to contribute to settlement.
  • Filed successful Motion to Dismiss false advertising claims against Amazon retailer resulting in dismissal of all claims.
  • Obtained complete victory for client accused of wrongful termination and battery on successful Motions for Summary Judgment and Motion for Judgment on the Pleadings.
  • Successfully appealed default judgment which had resulted in small church losing possession of its property.
  • Mediated settlement with home flipper and real estate brokers on claims for construction defects, fraud, and failure to disclose resulting in home flipper repurchasing property at increased fair market value and payment of damages.
  • Successfully resolved numerous claims involving infringement of intellectual property rights (trademarks and copyrights), employment claims, and other business disputes.
