Sean A. O’Brien is a partner at Payne & Fears LLP where he practices business and employment litigation, with a particular focus on trade secrets, unfair competition, trademark and wage and hour class action litigation.
Sean successfully defended The Boeing Company and Bank of America in various employment disputes, including wrongful termination, discrimination, retaliation and whistle-blower claims, and represented the Safeway/Vons grocery chain in various wage and hour class action matters.
He has handled numerous litigation matters for The Irvine Company, including construction defects, commercial lease, property management disputes and a high profile case regarding valuation of The Irvine Company. Sean also has handled several litigation matters for the California Angels Major League Baseball Team, including a high profile dispute between the Angels, the City of Anaheim and the Rams NFL franchise concerning rights to use Anaheim Stadium and its parking facilities.
Sean developed a nationwide strategy for Honda North America, Inc. for responding to discovery issues in product liability litigation involving their All Terrain Vehicle, and successfully defended several distributor cases for large multi-level marketing organization, Herbalife International, Inc., including a six-week trial in Arizona.
Sean is a member of the Association of Business Trial Lawyers, Orange County Chapter, and has been a member of the Continuing Education of the Bar, State Bar Business Intellectual Property Law Advisory Committee since 2002. He has authored several articles on business and employment matters, and is a frequent speaker at various seminars.
Before joining Payne & Fears LLP, Sean was a litigation associate and of counsel at Paul, Hastings, Janofsky & Walker LLP in Orange County.
