Rod Sorensen is the managing partner of the Silicon Valley office and a partner in the Employment Law Group. Over the past 15 years, he has focused on all types of employment litigation, including wage and hour, trade secrets, wrongful termination, discrimination and sexual harassment in state and federal court proceedings, administrative hearings, mediation and arbitration.
Rod also counsels employers on issues arising under state and federal employment laws, and conducts in-house employment law training programs. He also advises employers regarding the protection of proprietary information, litigation avoidance, drafting compensation and severance packages, reductions in force and workplace violence.
Rod has successfully defended employers against numerous employee claims of sexual harassment, discrimination, retaliation, defamation and wrongful termination. He recently prepared a successful appeal that resulted in a published decision by the California Court of Appeal. That favorable decision, which benefits all California employers, clarifies the law with respect to the scope of permissible discovery in employment litigation. He also has obtained injunctive relief against employees for misappropriation of proprietary information, and secured summary judgment/adjudication in favor of employers in a multitude of cases, including class action wage and hour litigation, wrongful termination and disability discrimination.
Rod has obtained multiple verdicts on behalf of employers in hearings before the California Labor Commissioner, and has obtained multiple workplace violence temporary restraining orders and injunctions.
Rod was an Editor of the Santa Clara University Law Review and a member of the Moot Court Board. He received the American Jurisprudence Award for his outstanding achievement in Contracts. He also was an Emery Merit Scholarship recipient.
Before joining Payne & Fears LLP, Rod was a partner in the employment law department of DLA Piper, US LLP.
