Daniel F. Fears is a partner at Payne & Fears LLP where he specializes in employment law and litigation.  Mr. Fears has extensive experience representing employers in all aspects of labor and employment law, including wrongful termination litigation and preventive advice, employment and housing discrimination, labor-management relations, civil rights and other employment law litigation matters. 

Mr. Fears has successfully defended employers in a wide variety of employment law cases, including reported cases such as Sanchez v. City of Santa Ana, 936 F.2d 1027 (9th Cir. 1990); Tanzman v. Midwest Express Airlines, 916 F.Supp.1013 (S.D. Cal. 1996); Walker v. Boeing corp., 218 F.Supp.2d 1177 (S.D. Cal. 2002); and Lee v. Bank of America, 27 Cal.App.4th 197 (1994).

Mr. Fears previously served as the Chairman of the Labor Law Section of the Orange County Bar Association.  He is a past and present member of the Orange County Bar Association Resolutions Committee, a past and present delegate to the California State Bar Association Convention, and an active member off the American and California State Bar Associations.  Mr. Fears is AV rated by Martindale-Hubbell.

Mr. Fears frequently lectures and writes on various employment matters, including wrongful termination, employment discrimination, employee privacy issues and labor relations matters.  He co-authored the book Avoiding Wrongful Termination in the 1990’s: The Management Guide to Minimizing the Risks Posed by the Evolution of Wrongful Termination Law, published by American Somerset, Inc., 1990, and the publication entitled Employee Discharge & Documentation, published by Lorman Education Services, 2006.  Mr. Fears previously served as Research Editor for the San Diego Law Review and as a staff writer for the Public Interest Law Journal.   

Prior to founding Payne & Fears LLP, Mr. Fears was a partner in the employment law department at Paul, Hastings, Janofsky & Walker LLP.
